1 — SCOPE
This policy outlines the procedures relating to overtime for employees covered by the collective agreement with CUPE Local 3433 (69³ÉÈ˵çÓ°Íø Staff Association). Where there is a conflict between these procedures and the collective agreement, the collective agreement will prevail.
2 — POLICY
2.1 Authorization
All hours required by the University to be worked in excess of an employee's regular work day or an employee's regular work week constitute overtime and will be reimbursed in accordance with the applicable provisions of the collective agreement. Overtime must be specifically authorized by the employee's manager prior to the work being performed.
2.2 Claiming Overtime
Employees are to claim authorized overtime by completing the applicable screen in the University's Leave Tracking System and submitting it to the manager.
The overtime balance indicated in the University's Leave Tracking System represents the official University record.
2.3 Compensation for Overtime
The normal form of compensation for overtime will be time off at the appropriate overtime rate.
In the rare occasion when overtime is to be paid, the manager must receive the prior written approval of their Vice-President.
2.4 Taking Time Off
The normal form of compensation for overtime is time off.
Time off will be at a time mutually agreed between the employee and their manager. Time off will normally be taken within three (3) months of the overtime being worked. However time off may be taken at a later time if mutually agreed in writing. If the time off is not taken within three months and mutual agreement is not reached to take the time at a later date, the employee will be paid for the overtime in accordance with the provisions of the collective agreement. It is the responsibility of the manager to ensure that such payments are made.
Employees are to record time off by completing the applicable screen in the University's Leave Tracking System and submitting it to the manager.
An employee's bank of overtime credits will not normally exceed seventy (70) hours at any given time. When this limit is exceeded, the excess time must be taken off as soon as possible and in all cases within two months of the date that the limit was exceeded, subject to the provisions of the collective agreement.
The employee's manager is responsible for ensuring that time off is administered in accordance with this procedure and the provisions of the collective agreement.
2.5 Termination of Employment
Overtime authorized on the University's Leave Tracking System and not taken off as time off before an employee's termination date will be paid out to the employee on their final pay.
